Data Processing Agreement (DPA)

This Data Processing Agreement (“Agreement”) is entered into between:

Data Processor: MARKETHINK DOO, Stara Raskrsnica BB, Bjeliši, Bar, Montenegro

1. Purpose of Processing

The Data Processor will process personal data on behalf of the Data Controller strictly for the purpose of delivering digital marketing services, including but not limited to email campaigns, lead generation, audience targeting, and content distribution.

2. Categories of Data

Data may include: names, email addresses, phone numbers, company information, job titles, IP addresses, behavioral analytics, and any other relevant data supplied by the Controller.

3. Data Subject Rights

The Processor shall assist the Controller in fulfilling its obligations to respond to data subject requests under GDPR (access, rectification, deletion, objection, portability).

4. Security Measures

The Processor shall implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including encryption, access control, and regular audits.

5. Sub-Processors

The Processor may use trusted third-party services such as email delivery providers (e.g. Mailchimp, Brevo), hosting platforms, and analytics tools, all of which are GDPR compliant. A full list is available upon request.

6. Data Retention and Deletion

Upon completion of the services or upon request from the Controller, the Processor shall delete or return all personal data, unless otherwise required by law.

7. Breach Notification

The Processor shall notify the Controller without undue delay in the event of a personal data breach and provide all relevant information to support compliance and mitigation.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Montenegro and the applicable GDPR regulations of the European Union.
